1. Our Services
Digital Genius Technologies provides digital services including website development, web design, graphic design, branding, digital marketing, AI solutions and related services.
The exact scope of work, deliverables, fees and timelines will be agreed with the client before work begins.
2. Payment
All prices and payment terms will be communicated to the client before work starts.
Unless otherwise agreed:
A deposit or full payment may be required before work begins.
Work may be paused if payment is overdue.
Additional work outside the agreed scope may incur additional charges.
All payments made are subject to the agreed project and payment terms.
3. Website Content
The client is responsible for providing accurate text, images, logos, information and other materials required for the project.
The client must ensure that they have the necessary rights or permission to use any materials provided to us.
We are not responsible for delays caused by late or incomplete information from the client.
4. Project Changes and Revisions
The project will be completed according to the agreed scope of work.
Reasonable revisions included in the agreed package may be made during the project. Requests for significant changes or additional work may be charged separately.
5. Third-Party Services
Some projects may use third-party services, platforms or software such as hosting providers, domain registrars, payment gateways, plugins, advertising platforms or AI tools.
We are not responsible for changes, interruptions, price increases or technical problems caused by third-party providers.
6. Intellectual Property
Unless otherwise agreed, the client will receive the agreed final deliverables after full payment has been received.
Digital Genius Technologies retains ownership of its own tools, methods, templates, systems, code, designs and other materials that were created independently of the client’s project.
We may display completed work in our portfolio or marketing materials unless the client requests otherwise.
7. Website and Service Availability
We will make reasonable efforts to deliver our services professionally and within the agreed timeframe.
However, we cannot guarantee that a website, hosting service, software, advertising platform or other third-party service will always be available or error-free.
8. Client Responsibilities
The client agrees to:
Provide accurate and timely information.
Review and approve work within a reasonable time.
Make payments according to the agreed terms.
Ensure that their website content and business activities comply with applicable laws.
9. Limitation of Liability
Digital Genius Technologies will not be responsible for indirect or consequential losses, including loss of profits, business opportunities, revenue, data or goodwill resulting from the use of our services.
Our liability, where legally permitted, will be limited to the amount paid by the client for the specific service giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded under Malaysian law.
10. Cancellation and Termination
Either party may terminate a project in accordance with the agreed project terms.
If a client cancels a project after work has started, payment may be required for work already completed and approved expenses incurred.
11. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our services, technology or applicable laws.
The latest version will be published on our website.
12. Governing Law
These Terms and Conditions are governed by the laws of Malaysia.
Any disputes will be subject to the applicable laws and courts of Malaysia.
